Please read these Terms of Service ("Terms") carefully before using the SubmittalShop.com website or engaging our services. By accessing our website or submitting a project request, you agree to be bound by these Terms.

1. Services Provided

SubmittalShop provides drafting, documentation, and submittal preparation services ("Services") based on the architectural, engineering, and project specifications provided by the client. Our deliverables are intended solely to assist subcontractors and contractors in the submittal approval process.

2. Use of Project Information

By submitting project documents, plans, specifications, or any other information to SubmittalShop, you grant us and our authorized subcontractors the right to use, study, copy, and distribute these materials strictly for the purpose of preparing your requested shop drawings and submittals. We will not use your project information for any other commercial purpose without your explicit consent.

3. Marketing and Data Sharing

By using our Services and providing your contact information, you agree that SubmittalShop may use your email address and other contact details for marketing and promotional purposes. Furthermore, you consent to the sharing of your contact information with our trusted partners and affiliates for their marketing purposes.

4. Limitation of Liability (Design & Execution)

SubmittalShop is a drafting and documentation service, NOT a licensed engineering or architectural firm. We do not provide structural engineering, architectural design, or life-safety evaluations.

• No Design Liability: We are not liable for any design flaws, structural integrity issues, or code violations inherent in the original project documents or resulting from the fabrication/installation process.
• No Construction Liability: We are not responsible for the execution of construction, field measurements, site safety, or the means, methods, techniques, sequences, or procedures of construction.
• Verification Required: The client and their field personnel are solely responsible for verifying all dimensions, field conditions, and quantities prior to fabrication and installation.

5. Approval Process & Discretionary Use

All shop drawings, product data, and submittal packages prepared by SubmittalShop are generated for the express and sole purpose of review and approval by the project's Architect of Record (AOR) or Engineer of Record (EOR).

Even after receiving an "Approved" or "Approved as Noted" status from the AOR/EOR, the client utilizes the submittals at their own discretion and risk. Approval of a submittal does not relieve the contractor or subcontractor from their responsibility to comply with the original contract documents, nor does it transfer design liability to SubmittalShop.

6. Revisions and Modifications

We will perform revisions based on AOR/EOR review comments as outlined in your specific project proposal. Revisions resulting from changes in architectural design, field conditions, or client preference after the initial drafting phase may be subject to additional fees.

7. Indemnification

You agree to indemnify, defend, and hold harmless SubmittalShop, its officers, directors, employees, agents, and subcontractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our deliverables in the physical construction or fabrication process.
